Through Card Player, we learned of a small legal victory of poker, this time in the District Court of New Zealand.
Last week, David Harvey judge ruled that television ads promoting tournaments and online poker rooms do not violate the law of New Zealand. The case is launched by the Department of Internal Affairs by filing a lawsuit to TV3 and C4 channels claiming that the ads violated PokerStars.net the country’s laws concerning online gambling, an activity that is illegal in New Zealand.
The ad in question was the Asia Pacific Poker Tour and ended with PokerStars.net logo. However, Harvey’s decision was clear: “The nature of the ad makes it clear that they are free online sites that do not involve gambling.”
He also reaffirmed that APPT ads were within the margin of the law because in the tournament “input money is divided among the winning players. This is a competition that involves a game, in this case, the poker. ” It is expected that the Internal Affairs Department appeals the decision in the coming days .
